Litigation Specialist
Litigation Specialists have the primary responsibility for supporting the company’s efforts to timely maximize the company’s recoveries on the company’s most delinquent accounts while also: (a) wisely using the resources expended in pursuing the recoveries, and (b) thoughtfully identifying situations that might negatively impact the company in the future. There will of course be tension between the above objectives, so thoughtful analysis of potential outcomes is important. The responsibilities may include confirming debtors’ creditworthiness, collecting on accounts prior to referring to an attorney or agency, engaging collection counsel, overseeing and/or administering collection litigation (including pursuing bankruptcy claims), serving as a witness for GreatAmerica, collecting on judgments, assisting with negotiating settlements where appropriate, preparing and maintaining litigation files, reviewing expenses and assisting with managing costs.
The essential functions below apply to the Litigation Specialists team, but team members will share in these functions as directed by team leadership.
Essential Functions
- Take prompt action on accounts assigned by portfolio management to be litigated, sent to small claims, sent to collection agency or collected/settled.
- Review and direct outside counsel litigation work, with support from our inside attorneys as needed.
- Negotiate settlements and work out arrangements on individual accounts.
- Work with and manage third party collection agency activity on accounts referred out.
- Ensure proper documentation is in place in all matters related to litigation on accounts.
- Review costs associated with litigation on individual accounts. Seek to control expenses related to this process.
- Maintain current follow-up on accounts through the account list for the individual collector code assigned to the person.
- Protect portfolio assets through proper recovery and sale of assets.
- Build relationships with external counsel.
- Seek guidance or support from inside counsel when appropriate.
- Be prepared to act as a witness for GreatAmerica in the pre-trial discovery process and at trial.
- Pursue initiatives and processes designed to increase recovery on written off accounts.
- Be present during business hours with minimal absences (per GreatAmerica’s attendance policy).
- Perform other duties as requested.

Education: A bachelor’s degree is required (a paralegal certificate/degree is optional).
Experience: Two years of work experience is preferred, but not required.
